1. Welcome
These Terms of Service (“Terms”) are a binding agreement between you and Lokoway, the AI-assisted travel-planning service operated from Singapore (“Lokoway”, “we”, “us”). By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Lokoway.
2. Eligibility
Lokoway is not intended for children under the local age of digital consent (typically 13 in the United States, 16 in much of the European Union, and varying by country). If you are below that age, you may use Lokoway only with verifiable consent from a parent or legal guardian. We may suspend accounts we believe are operated by users below the applicable age without parental consent.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for everything that happens under your account. Tell us immediately if you suspect unauthorised access. You agree to provide accurate information when you sign up and to keep it current.
4. Your Content
“Your Content” means the trip plans, activities, captions, reviews, photos, file attachments, and other material you upload or create on Lokoway.
You own Your Content. You retain all rights to it.
License you grant to Lokoway. To operate the service, you grant Lokoway a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, transcode, adapt for display (including image resizing), and distribute Your Content as needed to provide Lokoway to you and to the audiences you choose. Specifically:
- For private content (default): the licence is limited to operating the service for you and your invited trip members.
- For trips you publish to the Inspiration Feed or share via a public link: the licence extends to displaying Your Content publicly to users of Lokoway and to anyone with the public link, until you unpublish, delete, or otherwise revoke that content.
The licence ends when you remove the relevant content from Lokoway, except for backup copies retained for a limited period and content that other users have legitimately incorporated into their own trips before removal.
If you leave a collaborative trip, you can choose whether your reviews, captions, and photos stay attached to that trip or are removed from it. If you choose to keep them, this licence continues for that content while it remains attached to the trip, unless it is later removed through an available account, support, or administrative path. If you choose to remove them, the licence ends for the removed content subject to the backup, safety, legal, and already-incorporated-copy exceptions above.
Other trip members and shared itinerary content. When you join a Lokoway trip and contribute itinerary content — activities, dates, locations, estimated costs, notes — you also grant Lokoway the licence above to display that itinerary content on the trip’s share-link and public-trip surfaces according to that trip’s sharing and publishing controls, even when another trip member is the publisher. This is necessary because Lokoway’s public and shared surfaces show the trip’s full non-private itinerary, not only the publisher’s contributions. Leaving a trip does not remove the shared itinerary structure. You retain the right to mark any activity Private while you are a trip member; private activities (and the photos and reviews attached to them) are hidden from share-link and public surfaces.
Photos and metadata. Photos you upload through the Lokoway web client are compressed in your browser before upload, which typically strips GPS and other EXIF metadata. This is not enforced on the server and we do not guarantee metadata removal on every upload path. Do not upload photos containing sensitive metadata you would not want to share.
5. Acceptable Use
You will not use Lokoway to upload, post, or share content that:
- depicts violence, sexual content, or nudity;
- constitutes hate speech, harassment, or threats;
- is spam, deceptive, or commercially misleading;
- infringes another person’s intellectual-property rights, privacy, or publicity rights;
- violates applicable law or facilitates illegal activity;
- impersonates another person or misrepresents your affiliation;
- circumvents our moderation, rate-limiting, or security controls;
- includes other people (especially children) who have not consented to their image or details being shared.
You are also responsible for the photos and details you publish about other people; obtain their consent before sharing identifying material.
6. AI-Generated Information
Lokoway’s planning assistant (Loko) uses Google Gemini to suggest itineraries, activities, opening hours, and travel facts. AI-generated information may contain errors. Always verify visa requirements, opening hours, transit schedules, safety advisories, and other critical details with official sources before you travel. Lokoway is a research and planning helper; it is not a substitute for official government, embassy, or operator information, and not a substitute for medical, legal, or financial advice.
7. Moderation, Takedown, and Reports
We screen uploaded photos with automated safety filters and review reports submitted by users. We may, at our discretion and without prior notice, remove content, hide content from public surfaces, take down published trips, suspend accounts, or terminate accounts that we believe violate these Terms or applicable law. Where practical, we will tell you what was removed and why.
If you see content that violates these Terms, use the in-app Report flow.
8. Intellectual-Property Claims
If you believe content on Lokoway infringes your intellectual-property rights, send a written notice to support@lokoway.com that includes:
- your contact information;
- a description of the work you claim is infringed;
- the URL or location on Lokoway of the allegedly infringing content;
- a statement, made in good faith, that the use is not authorised by you, your agent, or the law; and
- your physical or electronic signature.
We will review notices and remove or disable access to content we determine is likely infringing. The user who posted the content may file a counter-notice including their contact information, identifying the removed content, and stating in good faith that the removal was a mistake or misidentification. We may restore the content if the original claimant does not pursue legal action within a reasonable period after counter-notice.
9. Account Suspension and Termination
We may suspend or terminate your account for repeated or severe violations of these Terms, for legal or safety reasons, or for prolonged inactivity that risks the integrity of the service.
You may delete your account at any time from Settings. On deletion:
- Your private trips, AI memories, and content you personally uploaded are removed from the live product.
- Your profile is removed from discovery / following.
- Solo published trips are removed from public view.
- For group trips, only your own contributions are removed; the trip may remain if other members still own or contribute to it.
- Your username is reserved permanently as a security measure to prevent impersonation of former users (legitimate interest).
- Backup copies of removed data may persist for a limited period under our hosting and database backup cycles before they are overwritten.
10. Affiliate Booking Links
Lokoway may show booking links for third-party travel providers when we have a matching booking destination for an activity. These links take you to the provider’s own website or app; the provider is responsible for the booking flow, payment, refunds, customer support, and any travel service you buy from them.
Some booking links are affiliate links, which means Lokoway may earn a commission if you book through them, at no extra cost to you. Commission-bearing actions will include a visible in-product disclosure near the booking action.
11. Purchases
Lokoway is free to use during launch. We may offer paid features later, such as trip planning packs or other add-ons. If paid features are available, their sizes, prices, and terms will be shown before checkout.
Merchant of record. If paid checkout is enabled, purchases are processed by Lemon Squeezy, the merchant of record. Lemon Squeezy collects and remits applicable taxes (e.g. GST, VAT, sales tax) based on your billing location. Your purchase agreement and receipt are issued by Lemon Squeezy.
Pricing and currency. If paid features are available, prices are shown in the currency selected at checkout. Prices may change at any time; the price you see at checkout is the price you pay for that purchase.
Refunds. Paid digital features may be consumable credits. Once delivered to your account they are not refundable, except where a refund is required by applicable consumer-protection law.
Chargebacks and disputes. If you initiate a chargeback or payment dispute with your card issuer or payment provider for a purchase, we may suspend your account pending resolution.
12. Service Availability and Changes
Lokoway is offered “as is”. We may add, change, or remove features at any time. We may also suspend the service for maintenance or for reasons outside our control. We do not guarantee uptime, error-free operation, or specific results.
13. Limitation of Liability
To the maximum extent permitted by law, Lokoway is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the service. Our total cumulative liability to you for any claim relating to Lokoway will not exceed the amount you paid us for the service in the twelve months preceding the claim, or, if you paid us nothing, one hundred United States dollars (US$100).
Some jurisdictions do not allow the limits above; in that case the limits apply to the maximum extent permitted by your local law.
14. Indemnification
You agree to indemnify and hold Lokoway harmless from claims arising out of Your Content, your violation of these Terms, or your violation of another person’s rights.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the rest of the Terms remain in effect, and the invalid provision will be enforced to the maximum extent permitted by law.
16. Force Majeure
We are not liable for any failure or delay caused by events outside our reasonable control, including natural disasters, war, civil unrest, government action, network or hosting-provider outages, and pandemics.
17. Dispute Resolution
If you have a dispute with Lokoway, contact us first at support@lokoway.com and we will attempt to resolve it informally. If we cannot reach a resolution within 30 days, the dispute will proceed under the Governing Law clause below.
18. Governing Law
These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles. Disputes are subject to the exclusive jurisdiction of the courts of Singapore.
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. If a change materially affects your rights, we will give you reasonable notice (e.g. an in-app prompt) and may ask you to re-accept. Continued use of Lokoway after the effective date of an update means you accept the updated Terms.
